| Submission of Advertisements Submission of Advertisements The submission of any advertisement is subject to the terms and conditions shown below. It will be deemed that by submitting any advertisement that these terms and conditions have been read, understood, and accepted. Payment is to be submitted with the advertisement, unless otherwise arranged. The advertisement will not be posted until payment has been received. These fees may be paid by either cash, postal order, cheque payable to 'madeira4u', bank transfer to NIB 0010 0000 35693050002 14 quoting a reference to the advertisement, or through paypal for debit or credit cards using the email address paypal@madeira4u.com. Payments in currencies other than euros can be accepted through paypal, but more options may be available on request. Please use the 'Contact Us' form to find the address to post payments and obtain further information. No refunds will be given once the advertisement has been correctly posted by madeira4u on its web site. All advertisements submitted must be of the maximum size stated for the payment amount made. If oversized submissions are received, then madeira4u.com reserves the right to reject them or reduce the size, at their discretion, to fit within the category paid for. madeira4u may increase the advertisement size for the purpose of fit and presentation on the webpage, at no extra charge. Any offensive or illegal content in the submitted advertisement will be removed or modified by madeira4u, if necessary without further consultation. Advertisers should check their advertisements immediately after it is posted to the website, and notify any problems immediately to madeira4u. No guarantees are given as to the positioning of advertisements on the page(s) chosen, although in general they will initially be placed in order of receipt from top to bottom, and left to right. They may be moved within the same category should a new page be necessary, or in order to optimise existing space (as they would in a newspaper). Advertisements must be submitted in 'press ready' form, meaning no further modification is needed in size or content by madeira4u.com prior to listing on the web site, except for the three smallest sizes of classified advertisements where some design work has been paid for, or where otherwise agreed. Should madeira4u need to make any changes, then this may be chargeable work if agreed with the advertiser, or will be rejected if not. Advertisements can be prepared and formatted by madeira4u, for a one-off charge as specified on the price list for a plain box, or as otherwise agreed for larger and more complex requirements. Payment for a specified size of advertisement will include one hyper link to the advertisers website URL, or email enquiry form link (usually opens a new email window on the users computer, but that can depend on that computer's settings). Advertisers should ensure that the requirements for this are specific and clear when submitting advertisements or specifications, otherwise these links may not work. Additional links can be purchased - please refer to the price list. Advertisers are free to design their own advertisement using text, pictures and graphics and whatever colours they choose. madeira4u undertakes to reproduce the quality to the best of its technical ability, but will not guarantee a 100% likeness in colours and quality to the artwork submitted. If the end result is unsatisfactory and madeira4u is notified with 2 weeks of posting, then madeira4u undertakes to make improvements at no further charge, and if that is not possible refund any fees paid. The sizes available for each advertisement box or format is based on using a standard 19" (48cm) screen or computer monitor on normal 100% default viewing settings. The actual viewing size for any advertisement will be based on the size of the viewers screen, and the users screen settings, so, for example, small advertisements may not appear easily readable on a mobile telephone screen. In the event of any advertiser wishing to substitute or amend an advertisement once it has been posted, this can normally only be done by withdrawing the original and resubmitting a new copy, with the original charge payable again. However, if the change is small and simple (for example a change in price, email address or telephone number), then on request madeira4u may offer to make the change at no extra charge. Advertisements that infringe English or Portuguese law, or are of an obscene nature, or are likely be construed as offensive to users of madeira4u will be modified to meet acceptable standards, or will be rejected. All advertisements will be maintained online for the period of one year from the date of first posting, unless agreed otherwise, or the advertisement is no longer valid (i.e. a property has been sold, or an advertiser has gone out of business). Advertisements will be renewed by agreement between the advertiser and madeira4u before the subsequent year begins, or will be removed. Renewal without change entitles the advertiser to a special discount as shown on the price list. Advertisement renewals, without alterations, will attract discounts after the first full year of advertising, as shown on the price lists. Once the advertisement expiry has passed, the full prices are payable for renewal, and where applicable the set-up charge will be incurred again. Should advertisers wish to place further advertisements in more than one category within Products & Services, then the prices shown in the price list apply. However, if the additional advertisement(s) are identical in size, format and content to the first one, each additional advertisement will be charged at half the price paid for the first advertisement, based on current prices. The first advertisement placed will attract the early renewal discount, any others will not. Advertisers should submit their contact name, business name if applicable, address, telephone number, business and fiscal numbers as applicable, and website URL (if any) and email account to madeira4u. These will be kept on record for future contact, but will not be made available to any other party unless included in the advertisement, or as necessary for business reasons. No IVA (VAT) will be charged during 2008, but should it be necessary in future then all advertisers affected will be informed on renewal. IVA (VAT) will not be backdated nor apply to the remainder of any agreed advertising term, should it become payable, and will only start with a new contract or renewal. | GENERAL TERMS & CONDITIONS General terms and conditions of participation for all advertisers: These terms are provided for the benefit and protection of this website's users, and buyers of property, goods and services. 1. All site content must be provided in english, and any contact persons or points provided must be able to communicate with a reasonable standard of both the written and spoken english language. Business names and addresses will be in Portuguese. 2. Advertisers of any nature must agree to be bound by a short code of ethics. a). The quality of the items(s) or service(s) for sale will be guaranteed by the seller, as advertised and as specified by Portuguese or English law, as applicable. Where the sale or purchase of property is involved, both buyer and seller need to ensure legal protection in this respect and in some circumstances for other expensive items, such as cars and boats. madeira4u is exempted from any liability whatsoever in this respect, and the placing of any advertising will confirm the advertisers acceptance of this. b). All enquiries will be dealt with promptly. c). All undertakings to the client will be executed in full in the timescale agreed, unless otherwise agreed in writing with the buyer. If this cannot be agreed, the buyer is released from any further obligation to buy, and is free to cancel any order. d). Customer complaints will be dealt with promptly, and if necessary action taken to resolve the defective product or service. This website cannot provide assistance in the resolution of complaints involving advertisers, but will act to highlight and eventually remove advertisers who, in their opinion, fail in their obligations, from the website advertising directory. e). Prices charged and the product and service quality for anything advertised on madeira4u.com will be identical (or on the same basis) for all customers regardless of their nationality, gender, race, religion, or other personal orientations. f). In the event of the completed sale of property or 'one-off' items, or in the event of closure of the advertisers business, madeira4u.com or its agent must be informed immediately, in order to facilitate the prompt removal of the advertisement (in any event within one week). g). Failure to comply with the foregoing terms and conditions may disqualify the supplier from further advertising on this website. 3). Any fees chargeable for any advertising requirements notified and accepted for inclusion on this website, will be payable in full, in advance of any design work if necessary, and before publication. 4). All information provided on this website is currently and will always be the property of the website designer and content author. No information is to be taken for anything other than personal use, without written consent to do so from madeira4u. 5). Whilst every effort is made to ensure the information provided by madeira4u on its website or in any other manner, is accurate and up-to-date, no guarantees are offered or implied and the concept of 'buyer beware' applies. All users of madeira4u.com shall satisfy themselves as to the veracity of any information of any importance before making any level of commitment, undertaking or expenditure. 6). All sellers (advertisers) must either: a) be the rightful and legal owners of the subject of the advertisement(s) under either english or portuguese law as applicable. Property advertised for rent, must have the appropriate and valid licences as required and issued by the Madeiran authorities. All products and services advertised must be legally saleable under either English or Portuguese law as applicable, and comply in all respects with any legislation that affects that item, for example health and safety legislation. 7). Other terms and conditions may apply for advertising specific products or services, i.e. property sales. These will be made clear on the specific pages for that advertisement. 8). Privacy of the sites users and advertisers will be maintained, and aside from advertising content, and the provision of necessary contact details, no information will be released to any third party without the express written permission of the subject of such information. 9). The accuracy of information provided for advertisements is the responsibility of the advertiser, and they should check on the madeira4u website within 2 weeks of placement of the order to ensure the correct information is displayed and the URL and email links function correctly and advise madeira4u promptly of any problems. Errors of any type made by madeira4u or its representatives, will be corrected promptly upon notification, and any liability for serious errors will entitle the advertiser only to a free extension of the duration of the advertisement equal to the time the error had been on display, or in exceptional circumstances (where the advertiser may have lost business) to a proportional refund of the payment made whilst the error was visible on the website. madeira4u cannot accept liability for advertisers errors, but will assist with rectification of the advertisement where possible, hence advertisers must ensure that the information they submit is accurate and clearly readable by madeira4u staff. 10). Once advertising has lapsed or been cancelled, for whatever reason, any promotional material such as the window sticker provided must be removed from public display. The window stickers are and will remain the property of madeira4u. 11). madeira4u will attempt to ensure through its terms, conditions, policies, and monitoring, that all users of this website are protected from deception, fraud, and poor quality goods and services. madeira4u will not, however, be held responsible for any breach or unacceptable conduct by any user of this website, and anyone using this website is deemed to accept that fact. Notwithstanding, madeira4u may attempt, where possible and without obligation, to assist to resolve any serious problems arising between advertisers and buyers, where every prior effort has failed. | TERMS & CONDITIONS FOR PROPERTY ADVERTISEMENTS Terms & Conditions For Property Advertisements As well as the general terms and conditions for this website, advertisers and site users must accept the following terms and requirements before advertising or responding to property for sale or rent, or responding to property wanted advertisements. madeira4u cannot be held responsible for the accuracy of descriptions or photographs, or any other information provided in the property sections of this website. Furthermore, users of the facilities in whatever capacity must undertake to be accurate and honest in their descriptions, and all enquiries must be genuine. All prices for new advertisements are based on the information being received in a 'ready to post' format, meaning advertisers provide digital photographs, and text that can be copied and pasted onto a computer screen without the need for retyping. If you are unable to submit your advertisement in this way or have further enquiries, please contact property@madeira4u.com for more details, or use the 'Contact Us' form. Property For Sale & To Rent Clients may use this site only for selling or renting out property, except for real estate or related companies, who may also advertise their business. The selling price must be specified, and required rent should be outlined according to seasonal variations. Accurate descriptions, location and position of the property advertised, must be provided, to avoid wasting the time of potential buyers or renters. It is the advertisers responsibility to comply with regulations governing property sales, rental and licences. The normal cost of advertising property for sale or rent on this website are shown on the property pages. This price will entitle the advertiser to keep the property advertised for up to one year, unless sold or removed previously. After that time the seller can renew the same and identical advertisement for the whole of the following year with a discount of 20%. Lapse or withdrawal of the original advertisement will terminate the discount offer. Minor and infrequent changes to details are permitted (such as reducing the selling price), but significant alterations may involve a further fee. Contact Us for details, if needed. No fees will be refunded if the property is sold, rented or withdrawn from the website, before the paid advertising year has finished. Information and photographs for the advertisement should be emailed to property@madeira4u.com, and any fees due should be paid at that time. Property Wanted & Prospective Buyers Anyone may use this website to obtain details for buying or renting property. However, if clients wish, they can also register their requirements to buy or rent property to allow non advertising sellers and renters to make contact (if they can match their property to the clients description).
